DELHI HIGH COURT IN THE CASE OF Saraswati Trading Company Section 29 of the CGST Act, 2017
?The petitioner, a sole proprietor of M/s. Saraswati Trading Company, sought to cancel their GST registration from 01.10.2022. However, the application was initially rejected because the petitioner did not submit required documents, such as reconciliation statements and KYC details. The GST registration was eventually cancelled, but with retrospective effect from 29.11.2019, which the petitioner contested.
?The court noted that cancellation of GST registration does not absolve the taxpayer from liability or prevent further statutory actions. The court directed the proper officer to reconsider the petitioner's request for cancellation from 01.10.2022, provided the petitioner submits the required documents within two weeks. The petition was disposed of with instructions that the proper officer must process the application if satisfied with the submitted documents, while clarifying that the petitioner remains responsible for any outstanding tax liabilities or statutory violations.
