MADRAS HIGH COURT IN THE CASE OF Itares Shoes Private Limited 73 of the CGST Act, 2017 

????The petitioner challenges an order dated 28.03.2024, concerning a GST demand based on a mismatch between e-way bills and GSTR 3B returns for 2018-19 to 2020-21. The petitioner received the demand notice on 21.12.2023, submitted replies, and further explanations with supporting documents later. 

????They argued that non-taxable supplies caused the mismatch and that they were not given a chance to address issues related to Form ITC-04 filings. The petitioner is willing to pay ?3.5 crore towards the disputed tax if given more time.

????The court set aside the order dated 28.03.2024, provided the petitioner pays ?3.5 crore within six weeks and submits a comprehensive reply with documents. 

????The respondent must then offer a personal hearing and issue a new order within three months. The petition was disposed of with no cost orders.
