BOMBAY HIGH COURT IN THE CASE OF Galaxy International

?In this case, the petitioner challenged the freezing of their bank account by the authorities. The petitioner was initially unaware of an order dated 8th May 2024 that froze their account, and this information was only disclosed later by the respondent. The court noted that the respondents failed to inform the petitioner and the court about the order, causing unnecessary complications.

?The court expressed concern over the lack of proper communication from the revenue department's officers to their legal representatives, which led to an embarrassing situation for the advocates and potentially weakened the revenue's case. The court directed the Principal Secretary of the Ministry of Revenue to conduct an inquiry into the lapse, take disciplinary action if necessary, and ensure that officers provide timely instructions in the future.

?The court also ordered the Principal Commissioner, Gurugram, to file an affidavit explaining the lapses by 30th August 2024. If the affidavit is not filed, the court will assume there is no objection to granting the relief sought by the petitioner. The matter was adjourned to 9th September 2024, with a directive to forward the court's order to the Revenue Secretary, Ministry of Finance.
